Cargolux<\/strong>, por meio da qual 7 dos 10 ministros confirmaram que os limites de responsabilidade previstos na Conven\u00e7\u00e3o de Montreal (\u201cMC99\u201d) para cargas devem ser observados.<\/h3>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Introdu\u00e7\u00e3o<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Essa decis\u00e3o representou um avan\u00e7o positivo e gerou a expectativa de que colocaria fim \u00e0 abordagem inconsistente dos tribunais brasileiros, que aplicavam as conven\u00e7\u00f5es internacionais de transporte a\u00e9reo \u00e0s demandas de consumidores, mas n\u00e3o \u00e0s a\u00e7\u00f5es propostas por seguradoras sub-rogadas em sinistros de carga a\u00e9rea. Neste artigo, analisamos a jurisprud\u00eancia formada ap\u00f3s essa decis\u00e3o.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Tribunal de Justi\u00e7a de S\u00e3o Paulo (2\u00aa Inst\u00e2ncia)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">No mais importante tribunal estadual do Brasil, <strong>26 de 55 decis\u00f5es<\/strong> proferidas aplicaram corretamente a MC99.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em dois casos, os desembargadores mencionaram expressamente que a inclus\u00e3o da sigla <strong>\u201cNVD\u201d<\/strong> (<em>No Value Declared<\/em> ou \u201csem valor declarado\u201d) no conhecimento a\u00e9reo constitui prova de que a responsabilidade da transportadora estava limitada, nos termos do artigo 22.3 da MC99. Em outra decis\u00e3o, o tribunal afirmou que n\u00e3o houve declara\u00e7\u00e3o de valor no conhecimento a\u00e9reo e acrescentou que as faturas anexadas a esse documento n\u00e3o podem ser consideradas declara\u00e7\u00e3o de valor apta a afastar a aplica\u00e7\u00e3o do limite de responsabilidade baseado no peso da carga previsto na MC99.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Surpreendentemente, em <strong>25 decis\u00f5es<\/strong>, o tribunal reconheceu a aplicabilidade da MC99, mas deixou de aplicar os limites de responsabilidade da Conven\u00e7\u00e3o sob o entendimento equivocado de que as faturas anexadas ao conhecimento a\u00e9reo constitu\u00edam uma declara\u00e7\u00e3o de valor da carga.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tamb\u00e9m foi identificada uma decis\u00e3o que concluiu que a declara\u00e7\u00e3o de valor para fins aduaneiros constante do conhecimento a\u00e9reo equivaleria \u00e0 declara\u00e7\u00e3o especial de valor da carga prevista no artigo 22.3 da MC99. Novamente, trata-se de uma interpreta\u00e7\u00e3o incorreta tanto do conhecimento a\u00e9reo quanto do texto da Conven\u00e7\u00e3o. Tal entendimento busca contornar a exig\u00eancia formal de declara\u00e7\u00e3o de valor prevista na Conven\u00e7\u00e3o, ignorando ainda a necessidade de pagamento suplementar correspondente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A an\u00e1lise da jurisprud\u00eancia da 2\u00aa Inst\u00e2ncia de S\u00e3o Paulo, bem como do Superior Tribunal de Justi\u00e7a (STJ) e do STF (conforme abordado abaixo), compreendeu o per\u00edodo entre maio e agosto de 2024, uma vez que o ac\u00f3rd\u00e3o do STF no caso <strong>Sura v. Cargolux<\/strong> foi publicado no final de abril de 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por fim, em quatro decis\u00f5es, entendeu-se que a MC99 n\u00e3o deveria ser aplicada porque a Conven\u00e7\u00e3o se destinaria apenas a demandas de consumidores. Para tanto, o tribunal baseou-se no entendimento fixado pelo STF nos precedentes hist\u00f3ricos de 2017. Essa posi\u00e7\u00e3o ignora a decis\u00e3o mais recente do STF em <strong>Sura v. Cargolux<\/strong>, que esclareceu que o entendimento consolidado em 2017 tamb\u00e9m deve abranger disputas relacionadas ao transporte a\u00e9reo de cargas.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A posi\u00e7\u00e3o do STJ e do STF<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O STJ e o STF s\u00e3o os tribunais superiores do Brasil. O primeiro analisa casos envolvendo poss\u00edveis viola\u00e7\u00f5es \u00e0 legisla\u00e7\u00e3o federal (como a MC99, uma vez incorporada ao ordenamento jur\u00eddico brasileiro), enquanto o segundo julga quest\u00f5es relacionadas a viola\u00e7\u00f5es da Constitui\u00e7\u00e3o Federal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O STJ proferiu decis\u00f5es em cinco casos. Em tr\u00eas deles, determinou que os processos fossem novamente julgados pelo tribunal de segunda inst\u00e2ncia \u00e0 luz da MC99. Desses tr\u00eas casos:<\/p>\n\n\n\n<ul class=\"wp-block-list is-type-dot wp-block-list\">\n<li>um ainda aguarda julgamento pela 2\u00aa Inst\u00e2ncia de S\u00e3o Paulo;<\/li>\n\n\n\n<li>outro foi julgado incorretamente, pois o tribunal entendeu que houve declara\u00e7\u00e3o de valor por meio das faturas anexadas. Foi interposto novo recurso ao STJ e aguarda-se decis\u00e3o;<\/li>\n\n\n\n<li>no terceiro caso, a 2\u00aa Inst\u00e2ncia de S\u00e3o Paulo aplicou a MC99 conforme determinado pelo STJ, mas ignorou os limites de responsabilidade para cargas. Um novo recurso foi apresentado ao STJ e teve \u00eaxito na aplica\u00e7\u00e3o dos limites previstos na MC99.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Desde ent\u00e3o, o STF proferiu <strong>13 decis\u00f5es<\/strong> por meio de julgamentos monocr\u00e1ticos de diferentes ministros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Apenas duas delas (incluindo uma decis\u00e3o recente de outubro de 2024) afastaram a aplica\u00e7\u00e3o das conven\u00e7\u00f5es internacionais sob o fundamento de que o entendimento fixado pelo STF em 2017 se aplicaria exclusivamente a demandas envolvendo transporte de passageiros e bagagem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recentemente, dois casos no STF foram julgados por \u00f3rg\u00e3os colegiados e decididos em conson\u00e2ncia com o precedente estabelecido em <strong>Sura v. Cargolux<\/strong>. O fato de ainda n\u00e3o haver uniformidade absoluta na Corte mant\u00e9m aberta a possibilidade de reavalia\u00e7\u00e3o da jurisprud\u00eancia divergente e, eventualmente, de revis\u00e3o da posi\u00e7\u00e3o majorit\u00e1ria adotada nesse caso. Contudo, considerando que sete dos dez ministros se manifestaram favoravelmente \u00e0 aplica\u00e7\u00e3o da MC99 \u00e0s reclama\u00e7\u00f5es relacionadas ao transporte de carga, entendemos que, neste momento, uma mudan\u00e7a de orienta\u00e7\u00e3o no STF \u00e9 pouco prov\u00e1vel.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclus\u00e3o<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">De modo geral, a jurisprud\u00eancia do STJ e do STF \u00e9 positiva. Entretanto, ainda persistem decis\u00f5es divergentes nos tribunais inferiores, que n\u00e3o aplicam adequadamente os limites de responsabilidade previstos na MC99 em demandas envolvendo cargas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do ponto de vista estat\u00edstico, a maioria dos processos se encerra na segunda inst\u00e2ncia, j\u00e1 que apenas uma pequena parcela obt\u00e9m autoriza\u00e7\u00e3o para recorrer ao STJ e ao STF.
