O novo marco estabelece prazos de resposta mais curtos e deveres de coordena\u00e7\u00e3o mais claros, com previs\u00e3o de entrada em vigor ainda este ano.<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A proposta tem como objetivo transformar pr\u00e1ticas de assist\u00eancia atualmente adotadas em obriga\u00e7\u00f5es legais, alinhadas a modelos internacionais j\u00e1 implementados em outras jurisdi\u00e7\u00f5es relevantes. Atualmente, essas medidas s\u00e3o reguladas pela Ag\u00eancia Nacional de Avia\u00e7\u00e3o Civil (ANAC) por meio de um conjunto de instrumentos administrativos.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u00c2mbito de aplica\u00e7\u00e3o<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O novo Projeto de Lei n\u00ba 5.031\/2024 aplica-se a:<\/p>\n\n\n\n<ul class=\"wp-block-list is-type-dot wp-block-list\">\n<li>familiares de v\u00edtimas fatais;<\/li>\n\n\n\n<li>familiares de pessoas desaparecidas;<\/li>\n\n\n\n<li>v\u00edtimas sobreviventes; e<\/li>\n\n\n\n<li>pessoas afetadas em solo<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Em decorr\u00eancia de acidentes envolvendo avia\u00e7\u00e3o comercial ou fretada ocorridos em territ\u00f3rio brasileiro, incluindo voos internacionais com origem ou destino no Brasil.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Mecanismo de coordena\u00e7\u00e3o institucional<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A proposta prev\u00ea a cria\u00e7\u00e3o de um comit\u00ea de coopera\u00e7\u00e3o coordenado pela ANAC, respons\u00e1vel por assegurar assist\u00eancia tempestiva, eficiente e humanizada \u00e0s v\u00edtimas e aos seus familiares.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A ANAC dever\u00e1 convidar os intervenientes relevantes para integrar o comit\u00ea no prazo de seis horas ap\u00f3s tomar conhecimento do acidente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Associa\u00e7\u00f5es de v\u00edtimas poder\u00e3o indicar representantes para acompanhar as atividades do comit\u00ea.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Obriga\u00e7\u00f5es das companhias a\u00e9reas<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As companhias a\u00e9reas ser\u00e3o obrigadas a:<\/p>\n\n\n\n<ul class=\"wp-block-list is-type-dot wp-block-list\">\n<li>prestar assist\u00eancia estruturada \u00e0s v\u00edtimas e aos seus familiares;<\/li>\n\n\n\n<li>manter planos locais de assist\u00eancia;<\/li>\n\n\n\n<li>apoiar a coordena\u00e7\u00e3o com as autoridades competentes;<\/li>\n\n\n\n<li>facilitar a comunica\u00e7\u00e3o com os familiares; e<\/li>\n\n\n\n<li>apoiar a instala\u00e7\u00e3o de centros de assist\u00eancia pr\u00f3ximos ao local do acidente, quando necess\u00e1rio.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Com base na nossa experi\u00eancia de assessoria a companhias a\u00e9reas ap\u00f3s incidentes de grande dimens\u00e3o, estas j\u00e1 operam com n\u00edveis semelhantes de resposta e coordena\u00e7\u00e3o.
