A decis\u00e3o representa uma importante vit\u00f3ria para a ind\u00fastria naval brasileira.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contexto<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">O regime de <strong>Pr\u00e9-REB<\/strong>, institu\u00eddo pela Lei Federal n\u00ba 9.432\/1997, incentiva a constru\u00e7\u00e3o naval no pa\u00eds por meio de benef\u00edcios fiscais e condi\u00e7\u00f5es especiais de financiamento. O casco de uma embarca\u00e7\u00e3o, constru\u00eddo por um estaleiro brasileiro, foi registrado sob esse regime. No entanto, o Tribunal Mar\u00edtimo cancelou o registro ao tomar conhecimento de que determinados componentes haviam sido importados, sustentando que o casco deixaria de atender aos requisitos necess\u00e1rios para usufruir dos benef\u00edcios do regime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">O CAR foi contratado pelo estaleiro para analisar o caso e contestar a decis\u00e3o do Tribunal Mar\u00edtimo.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quest\u00e3o em Discuss\u00e3o<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A principal quest\u00e3o era determinar se a importa\u00e7\u00e3o de determinados componentes invalidaria o registro da embarca\u00e7\u00e3o no regime de Pr\u00e9-REB, afetando, consequentemente, as condi\u00e7\u00f5es de financiamento e os benef\u00edcios fiscais associados.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Os principais argumentos do estaleiro foram os seguintes:<\/p>\n\n\n\n<ul class=\"wp-block-list is-type-dot wp-block-list\">\n<li>Construir uma embarca\u00e7\u00e3o utilizando exclusivamente recursos nacionais \u00e9 impratic\u00e1vel, dada a complexidade e a quantidade de componentes envolvidos.<\/li>\n\n\n\n<li>A embarca\u00e7\u00e3o foi constru\u00edda integralmente no Brasil ao longo de todo o processo de constru\u00e7\u00e3o, e o estaleiro apresentou provas inequ\u00edvocas de que empregou continuamente milhares de trabalhadores no projeto, contribuindo de forma significativa para a economia local.<\/li>\n\n\n\n<li>Os componentes importados representavam apenas uma parcela m\u00ednima da embarca\u00e7\u00e3o, tanto em termos de complexidade quanto de custo.<\/li>\n\n\n\n<li>N\u00e3o havia qualquer evid\u00eancia de descumprimento dos requisitos essenciais estabelecidos pela Lei Federal n\u00ba 9.432\/97, nem existia norma que restringisse ou proibisse a importa\u00e7\u00e3o de componentes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A posi\u00e7\u00e3o do Tribunal evoluiu gradualmente, passando do cancelamento do registro no regime de Pr\u00e9-REB \u00e0 prola\u00e7\u00e3o de uma decis\u00e3o final que restabeleceu integralmente o benef\u00edcio.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Em seu voto condutor, o magistrado cuja posi\u00e7\u00e3o prevaleceu afirmou:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u201c[&#8230;] as supostas \u2018lacunas normativas\u2019 relativas \u00e0s disposi\u00e7\u00f5es que regulamentam a concess\u00e3o do Pr\u00e9-REB n\u00e3o podem ser interpretadas de forma a prejudicar o estaleiro, especialmente em rela\u00e7\u00e3o a um ato j\u00e1 consumado e a uma embarca\u00e7\u00e3o j\u00e1 entregue, constru\u00edda com base em pressupostos legais e f\u00e1ticos leg\u00edtimos. Uma vez concedido o Pr\u00e9-REB e cumpridas as formalidades exigidas, em especial a constru\u00e7\u00e3o em estaleiro nacional, como ocorreu no presente caso, concretiza-se um ato jur\u00eddico perfeito que n\u00e3o pode ser desfeito posteriormente.\u201d<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Coment\u00e1rios<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Esta decis\u00e3o possui grande relev\u00e2ncia para a ind\u00fastria naval brasileira. Por meio desse julgamento, o Tribunal Mar\u00edtimo estabeleceu que:<\/p>\n\n\n\n<ul class=\"wp-block-list is-type-dot wp-block-list\">\n<li>A importa\u00e7\u00e3o de elementos limitados de um projeto n\u00e3o invalida o registro no regime de Pr\u00e9-REB, desde que a constru\u00e7\u00e3o ocorra no Brasil e a embarca\u00e7\u00e3o seja efetivamente constru\u00edda no pa\u00eds.<\/li>\n\n\n\n<li>O registro no regime de Pr\u00e9-REB n\u00e3o pode ser suspenso retroativamente em rela\u00e7\u00e3o a um per\u00edodo j\u00e1 transcorrido.<\/li>\n\n\n\n<li>N\u00e3o \u00e9 poss\u00edvel suspender o registro apenas em rela\u00e7\u00e3o a determinados elementos de um projeto, mantendo-o v\u00e1lido para os demais.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Esse precedente traz importante seguran\u00e7a jur\u00eddica quanto \u00e0 interpreta\u00e7\u00e3o do Tribunal Mar\u00edtimo sobre os requisitos para registro no regime de Pr\u00e9-REB.
